From a scientific point of view sodomy is an unhealthy practice (and I stress a scientific point of view), reasons being the increased likelihood of transmission of some sexually transmitted diseases through anal intercourse than through normal vaginal sexual intercourse. It is a fact that the anal lining made, mostly of mucus is thinner than that of the vagina, hence a high chance of that very lining to rupture and cause mixing of body fluids (Recall that sexually transmitted diseases like AIDS only prevails when there is mixture of body fluids like blood and semen). Some might argue that legalizing consensual sodomy would normalize it and encourage it. It would endanger not only the physical health but also the moral health of our nation, but let us not forget that the new bill also states that non-consensual sex with any human being (which in my opinion is a good step ahead, not only against women but any human including children, the handicaps and others) may result in not more than 45 years behind bars.
Adultery and divorce has already greatly weakened the social and legal foundation of the family as an institution in the Mauritian society and now with so many debates on consensual sodomy will further contribute to the erosion of the family some might say. as u say just a pretense. yah for sure but think about this situation if the bill is not adopted, you and your wife decide to pratice sodomy..n after sometimes, unfortunately it happens that your wife puts a case of sodomy against you (due to some dispute)..
what happens then?..
first you are accused and penalised and persecuted in this society of ours.
how r you going to defend yourself as the "medecin legiste" will surely discover that the act of sodomy has occured on your wife..
you are finished and sentenced.. because as it is now it is impossible to defend such a case..(think.....)..
however, this will also have its bad sides such as sexual criminals would be encouraged..and all that....
but i think the former point mentionned aboved gets the upper hand on everything...what you say man?
my point of view for this case is sodomy should be treated exactly like a rape case, its quite absurd wat the gove means by legalizing a form of rape Eh

a rape case between husband-wife i think would yield same level of complexity also for any other case. nevertheless if they want to legalize it its better to legalise it for man-man not man-woman and not man-child watever becoz for gays there are no alternatives but man-women have alternatives
@ Munna: Am perfectly in line with what you said ... as far as there is consensus law cannot interfere but if ever there is 1 pleading that there was no consensus it is considered as offense and may be solved by law and if found guilty the sentence can go up to 45 years imprisonment ... (let us not forget harsher penalties to be implemented in the new bill).
ReplyDelete@ A crooked mind people said... : The Bill is about condemning sexual offenses against human beings, at this point in time for Mauritius making laws applicable to only man and not women or vice versa is a step backward. The major purpose of the Bill was condemning sexual offenses against human being with harsher sentences and explicitly deals with most common offenses like object insertion (which is not there at this point in time). The only thing that is arousing so many polemics is that law will not interfere in any case whatsoever if there was CONSENSUAL sex no matter what sex practice it was.

c pa 45 ans automatik ca. c enn peine maximale allant zuska 45 ans. depan lor ban circonstances (blessures, viol collectif, si dimoune la handicapé etc...) 45ans li aussi ena enn deterant effect. Pareil now, ban chauffeurs evite boire kan condire acoz ena prison ladan. It is hope that enn peine severe will induce same on potential rapists.
cepedant mo daccord lor to l'opinion lor seki munna in dire. the fact of proving 'consent' remains same for any sexual assault.
